News of the World wins court battle to report John Terry "affair"

ENGLAND skipper John Terry has lost a battle to gag the News of the World from reporting his alleged affair with the girlfriend of ex team-mate Wayne Bridge. The Chelsea captain - who married Toni Poole (pictured right) in 2007 and is the father of twins - had won a controversial super-injunction preventing this newspaper from revealing the alleged affair with French model Vanessa Peroncel last Sunday.
The 29-year-old had successfully argued that publishing the claims would breach his right to a 'private and family life' under EU human rights law.
Terry has played alongside Bridge, who left Chelsea for Manchester City last year, in several England games and both were expected to go to the World Cup in South Africa.
Mr Justice Tugendhat said: "There has been wide circulation amongst those involved in the sport in question, including agents and others, and not just amongst those directly engaged in the sport.
"The fact that the information has become as widely available to so many people, means that an injunction is less necessary or proportionate than would otherwise be the case.
"Further, if - as I think likely - the real concern of the applicant in this case is the effect of publication upon the sponsorship business, then damages would be an adequate remedy if Terry succeeds at trial."
He concluded: "Freedom to live as one chooses is one of the most valuable freedoms.
"But so is the freedom to criticise - within the limits of the law - the conduct of other members of society as being socially harmful, or wrong."
Tom Crone, News of the World legal manager, said: "We welcome Mr Justice Tugendhat's decision as a long overdue breath of fresh air and common sense coming out of the privacy courts.
"Over recent years, there has been more prior restraint on freedom of speech in Britain than in any other democratic country in the world.
"Gagging orders like the one sought by John Terry have been granted to numerous other Premier League footballers and assorted celebrities.
"Hopefully today's victory by the News of the World will lead to a fundamental reassessment of our draconian privacy laws.
"The British public's right to know has been the victim of this legal process. Hopefully that will now change."

But an FA insider told Sportsmail last night that bad feeling among England's players towards Terry could see him dropped from the squad altogether. Capello recently spoke of how infighting had cost the Italy squad, of which he was a member, success in the 1974 World Cup.
'If Wayne Bridge does not want to play with him and the other players are upset, the issue is not the captaincy,' said the insider. 'It is about his presence - and if his presence is a problem he will have to be dropped as a player. Not as skipper.'

Because I'm not going to vent on the 230+ comment entry, I'll do it here:
I am breaking hiatus for this but whatever.John Terry is a dumbass.
But the fact of the matter is that men cheat, especially men with power. . .and he just happened to get caught -- again.
In general I think we have to separate that the person who shows up on the pitch is not the same man off it -- or at least I do. My policy is that just because someone kicks a ball around rather well, or happens to throw five touchdowns, or even golfs particularly well. . .these skills do not reflect of his or her own moral character (just like any other talent). The fact is that we put sports stars on pedestals just because they happen to be better at. . .well sports. And the fact of the matter is that they are specialists -- not morally special people.
That being said I think that cheating is horrendous. When you cheat on your wife you also cheat on your kids. I cannot say that I'm not disappointed. . .frankly I am. And though I love him as a player and a captain for my team, errhhh, he's by far not the sharpest knife in the drawer.
To end this on a light note. . .if Fabio sees fit to make the captain someone else. . .I'd be the first to suggest Rooney -- he's too ugly to get laid.

Capts are not supposed to do that. Chelsea is only now recovering from him betraying TSO for example because it so divided the team.
I think the next captain is Barry. He is Capello's number 1 player, he doesn't rock the boat, is non-controversial and doesn't come with baggage/major injuries/or super tempers

It depends what is required of an England captain in the 21st century. If the requirement is for a clean-living role model, one who never puts a foot wrong on or off the pitch, an ambassador for the England “brand”, Terry’s position is untenable (though it is hard to think of too many alternatives without the odd skeleton in their closet).
If the requirement is for the best leader, the man who exudes the qualities required of a captain on the pitch, there remains no one better.
The difficulty arises when those two spheres collide, when Terry’s conduct becomes such an issue that his authority and popularity on the pitch are eroded.
